1. SPECIFIC TERMS AND CONDITIONS OF TELEVISION SERVICES BY Epic
The terms and conditions of the present Agreement apply supplementary to the General Terms and Conditions of the Subscription Contract by Epic and composed are governing the TV Service by Epic. The Subscriber hereby agrees that Epic Ltd ("hereinafter Epic") will provide access to television services, as appropriate, in accordance with these Special Conditions which the Customer after he/she has read and understood fully accepted by signature.
"Additional TV Services" means additional services provided to the Subscriber, occasionally, as indicated on the official website of epic https:// www.epic.com.cy and require subscription to TV Service by Epic.
"TV Service by Epic" means the television subscription service provided to the Subscriber via broadband connection and which requires the subscription to the Internet and Telephony Services by Epic.
“TV GO by Epic Service” means the service broadcast to the Subscriber of the TV Service by Epic programs, with the use of the Network application for viewership on a tablet and/or a mobile smartphone.
"Parental Control System" means the functionality provided by Epic where content is accessed by using a Code (hereinafter "PIN"). The PIN will be provided to the Subscriber upon activation of the TV Service by Epic.
"Premises" means the premises of the Subscriber located at the address stated on the Agreement to which the TV Service by Epic is being provided to the Subscriber in accordance with the present Agreement.
" Public Viewing Premises" means the premises which have common areas for hosting guests of the Premises for earning profit or not, including but not limited to restaurants, clubs, pubs, cafeterias, cafés, canteens, betting agencies dining and / or entertainment, hotels.
"Purchase PIN" means the PIN that is provided to the Subscriber at the first activation of the TV Service by Epic and is used by the Subscriber to rent movies and/or content or to proceed with any changes of the TV Service by Epic.
«Set-Top-Box equipment or Equipment» means the terminal equipment which is provided to the subscriber by Epic and is essential to use the TV Service by Epic. The packaging of this terminal equipment includes a decoder, remote control, power and connectivity cables to the television set and the Demodulator (such as HDMI, Ethernet, RCA A / V).
"Television Services on Demand" means the service where the Subscriber of TV Service by Epic can rent content for a limited period and on ad hoc basis. Television Services on Demand are subject to the payment of a separate fee per event/content. The rental of the event is accomplished through a rental process by using a Purchase code (“PIN”).
3. PROVISION OF TV SERVICES BY Epic AND TV GO BY Epic SERVICE.
3.1. Subject to clause 9.2 below, the installation will occur within thirty (30) calendar days upon receiving the application requesting the provision of TV Service by Epic. It is provided Internet and Telephony services by Epic are already installed at the Subscriber’s Premises.
3.2. The provision of TV Service by Epic is feasible only in cases where there are available and appropriate network resources and there is appropriate connection speed. Epic shall not be obliged to provide the TV Service by Epic in case that epic will not be able to ensure the quality level required for the provision of the TV Service by Epic or in case that it is not technically feasible.
3.3 The provision of TV Service by Epic, requires subscription to the Internet and Telephony by Epic plans determined as compatible and appropriate to TV Service by Epic. The available and compatible plans as well as Eall relevant information are available on the official website of Epic at https://www.epic.com.cy. In case the subscription to a compatible Internet and Telephony by Epic plan is terminated (including porting out) then, the TV Service by Epic will also be terminated automatically. In that case, Epic is not obliged to compensate the Subscriber.
3.4. The provision of the TV Service by Epic is feasible and available only for the Subscriber’s use at his/her Premises as specified in the General Terms and Conditions of the Subscription contract.
3.5. The broadcast and/or the resale of the TV Service by Epic or part of it is prohibited.
3.6. In case of transfer of the Internet and Telephony Service by Epic to a different address and / or premise, then the TV Service by Epic will be transferred automatically along with other services provided, if any. Such transfer is possible provided that the provision of the TV Service by Epic is attainable at the new address and/or premise and there are available and appropriate network resources.
3.7 The TV GO by Epic Service is an add-on service of the TV Service by Epic which is provided for free. It is required that the TV Service by Epic is activated at the Subscriber’s premises.
3.8 The provision of the TV GO by Epic Service is available only within the Republic of Cyprus.
3.9 The provision of the TV GO by Epic Service is available only if it is downloaded on a device that supports iOS or ANDROID operating system provided that the Subscriber has access to the Internet and / or any available Wi-Fi Network which is offered by Epic. TV GO by Epic Service is not permitted on devices APPLE and ANDROID to which the Subscriber has obtained full or partial access on the operating system, on the files and the customization of the device (root or jailbreak).
3.11 Temporarily deactivation of the TV Service by Epic implies to temporarily deactivation of the TV GO by Epic Service from any type of connection.
3.12 Through the TV GO by Epic Service the Subscriber may not have access to audio-visual content where this is not permitted by the content provider.
4.1. For the provision of TV Service by epic a Set-Top-Box Equipment is required and is provided to the Subscriber including a decoder, remote control, power and connectivity cables to the television set and a demodulator (such as HDMI, Ethernet, RCA A / V). The equipment must be connected to the TV set and the Demodulator in accordance to the instructions set out in the user guide as provided by the manufacturer and/or epic along with the Equipment.
4.2. The Set-Top-Box Equipment is provided by epic only to the Subscriber and only for the use for the purposes of TV Service by epic. The Equipment is installed at the Premises of the Subscriber and remains at the exclusive ownership of epic. The use of the Set-Top-Box Equipment is strictly prohibited from any third party non-beneficiary of the TV Service by epic. In case the Subscriber requests the installation of the Set-Top-Box Equipment by epic, is obliged to pay to epic installation Fees in accordance to the current price list of epic.
4.3. The Subscriber is prohibited from intervening to the Set-Top-Box Equipment for any reason, especially for counterfeiting or copying identifiers, access credentials or the acquisition of the operating expertise of the Equipment and / or permitting any third party intervention, in addition to the authorized epic partners or epic staff. Each intervention, operation or modification or defect rectification of equipment is carried by epic staff or authorized partners.
4.4. epic shall bear no responsibility whatsoever for any damages or loss or inappropriate use caused to Set-Top-Box Equipment due to act and / or omission and / or negligence of the Subscriber, excluding normal wear and tear. In this case, the Subscriber is held liable and undertakes to pay epic any charge that may arise thereof.
4.5. Ensuring the safe and continuous operation of the Equipment bears the Subscriber.
4.6. epic reserves the right of remote access to the Subscriber’s Equipment for scheduled maintenance purposes, upgrade purposes, technical repairs or malfunctions, and/or for any other purpose required for the proper functioning of the TV Service by epic.
4.7. epic shall undertake the installation of the equipment for the provision of TV Service by epic to the Subscriber’s Premises in case technical setup and support is required. The Subscriber shall be obliged to ensure the correct cabling of the Premises before the installation of the Equipment and arrange the appropriate space and conditions required for the installation. If due to arrangement, design or structure of the Premises further cabling is needed then the Subscriber shall be obliged to undertake such task. epic shall bear no responsibility or whatsoever to undertake such task for cabling or any extension to the existing cabling setup or for any further installation of the TV Service by epic nor for any delay may be caused for the installation of the TV Service by epic.
5. TV SERVICE BY epic AUDIO VISUAL CONTENT – FAIR USAGE POLICY
5.1. epic reserves the right to add and/or remove television programs and/or channels and/or sub-services and applications and in accordance to its marketing policy, the TV Service by epic’s content and applications without the prior consent of the Subscriber.
5.2. The copyrights of the audiovisual content provided by TV Service by epic are protected and belong to their rightful owners.
5.3. The Subscriber is obliged to make proper use of the TV Service by epic in accordance with the present terms and the applicable legislation. By any means, it is strictly prohibited the presentation of the content and/or the use of the TV Service by epic at a Public Viewing Premise, the playback/distribution via the internet of the programs and/or content of the TV Service by epic and/or of the encryption/decoding keys as well as the disposal and/or concession of the content and/or the TV Service by epic by any means to third parties and/or the commercialization of the TV Service by epic. Moreover, it is strictly prohibited to copy or otherwise reproduce the content of the TV Service by epic, unless otherwise specified and limited by the present terms and conditions. In case of violation, epic reserves the right to discontinue the provision of the TV Service by epic at any time and to claim compensation for any damage.
In particular, and without limitation, the Subscriber is strictly prohibited:
a) To engage in activities that infringe IPRs. For example, the unauthorized peer-to-peer file-sharing, posting, streaming, making available, uploading, downloading or other distribution of content protected by IPRs; and/or
b) to facilitate such activities through hosted websites and services (including, but not limited to, the operation of eDonkey directory servers, BitTorrent trackers and/or websites which index and link to content served at a separate host).
5.4. In the event that it is found that TV Service by epic is used in a Public Viewing Premise and/or used in an illegal manner and/or in violation of the present terms allowing third parties to use the TV Service by epic and/or to have access to the content of the Service, then the Subscriber will receive notice where he/she will be informed that the present terms are violated. Failure to comply within the specified time, the TV Service by epic will be terminated. epic reserves the right to make the necessary, in its discretion, checks to determine the proper use of the TV Service by epic in accordance with the present terms and the applicable legislation.
5.5. Subject to clause 5.3, the Subscriber can record audiovisual content of the Service, for which the relevant functionality and right is provided by epic, and always via the Set-Top-Box Equipment provided exclusively for personal use.
5.6. ACCESS TO ADULT CONTENT AND ITS VIEWING IS STRICTLY INAPROPRIATE FOR MINORS. The Subscriber is solely responsible for the access to adult content by using the Parental Control System provided by the TV Service by epic. The Subscriber shall take all necessary measures to ensure and to prevent access to such content from minors.
5.7. epic is in no way responsible for the accuracy, reliability and use for any purpose of the audiovisual content transmitted and / or retransmitted via the TV Service by epic. epic accepts no responsibility for the audiovisual content of third parties which may affect the personality, honor, reputation, private and family life, professional, social, scientific, artistic, political or other relevant person's activity, whose image appears on the screen or whose name, or information is sufficient to determine which are broadcasted.
6. epic OBLIGATIONS AND RIGHTS
6.1. It is understood that epic will inform the Subscriber for any amendment and/or update of the present Terms and Conditions or the TV Service by epic generally either by notification to the Subscriber or by announcement in the daily press or on the epic’s website.
6.2. epic shall make every possible effort to ensure that the Subscriber’s request for upgrade and/or downgrade and/ or amend the Package/Plan selected, within and past minimum duration of the subscription period on time, according to the present terms and conditions, the applicable charges and fees and the commercial policies and procedures of epic.
6.3. epic reserves the right to temporarily suspend the TV Service by epic for maintenance or/and for technical support purposes by giving notice to the Subscriber on time.
6.4 epic reserves the right to immediately terminate the TV Service by epic in case that the Subscriber has engaged in any fraudulent activity against epic or uses the TV Service by epic in an offensive, abusive, dishonest, indecent manner and in general in any manner which contravenes the good morals and/or legislation and/or violates the rights of any third party.
6.5 epic reserves the right to maintain the user’s data, related to TV Service by epic, for customer experience purposes and / or for statistical purposes and / or for purposes related to the commercial development of the TV Service by epic.
7. SUBSCRIBER’s OBLIGATIONS
7.1. The Subscriber shall be obliged to legally maintain the ownership, possession and / or use of the Premises where the TV Service by epic will be installed.
7.2. The Subscriber shall use the TV Service by epic exclusively at the address mentioned on the contract to which the TV Service by epic is being provided and in accordance with the law and the epic's instructions. The Subscriber shall be obliged to keep epic covered and indemnified from any damage that epic shall suffer due to an act or omission of the Subscriber
7.3. The Subscriber shall ensure the security and confidentiality of the PIN and the Purchase PIN. In case of disclosure or use of the PIN and the Purchase PIN by third parties without the subscriber’s consent, the subscriber is obliged to report this immediately to epic.
7.4 The Subscriber accepts the specific terms and conditions of use of the TV GO by epic Service, as they appear in the application downloaded.
8.1. The Subscriber shall be obliged to pay the monthly invoice for the provision and usage of the TV Service by epic. In case that the invoice is not settled in full by the last day it is payable, then, epic shall suspend the TV Service by epic by giving the Subscriber thirty (30) days notice.
8.2. Any fixed monthly charges (e.g. monthly subscription fee, monthly payment of other charges, etc.) are charged pro-rated at the beginning of each month.
8.3. The TV Service by epic is a pro rata Service. In case of addition and/or activation of a new Service or any variation of the TV Service by epic during the month, the charges will be invoiced, proportionally, at the beginning of the next month.
8.4. Additional channels and / or services will be invoiced pro-rata on a monthly basis. For Television Services on Demand that are subject to a separate fee, charges will apply per order / rent of event and will be shown separately in the monthly invoice of the Subscriber.
8.5. For Television Services on Demand, the Subscriber is strictly obliged to follow the instructions as they appear on the TV screen. epic bears no responsibility for any charges that may arise for non-compliance with the instructions. The Subscriber shall be liable to pay all the charges arising from the Television Services on Demand, whether the Subscriber was aware or/and approved such services or not.
9. FAILURES / DAMAGES
9.1. Subject to clause 9.2 below, in the event of any failure of the TV Service by epic, the failure will be restored within reasonable time from the date the Subscriber reported the failure and in any case not more than 15 working days.9.2 The above terms and conditions do not apply in case of any delay in providing the TV Service by epic and/or in case of remedy of any failure to the TV Service by epic, which is not epic’s fault. Without limitation, the following cases constitute a reason of delay without epic’s liability:
9.2.1. Damages to epic’s network by third parties.
9.2.2. Damages not related to epic’s network but might affect the TV Service by epic.
9.2.3. When the Subscriber is not timely cooperating with epic’s personnel or there are pending actions to be done by the Subscriber.
9.2.4. When there is no availability of the TV Service by epic due to scheduled maintenance works by epic.
9.2.5. Force majeure and/or other events/incidents, actions and/or omissions outside epic's control.
10.1. epic reserves the right to terminate and/or suspend the TV Service by epic, with immediate effect, in case of violation of the present Agreement from the Subscriber by giving the Subscriber notice for breach of contract.
10.2. In every case of termination of the present Agreement, the Subscriber shall be obliged to return the Equipment to epic in a good and operational condition otherwise the Subscriber shall be liable to pay the value of the Equipment.
10.3 In case of early termination the Subscriber shall be obliged to pay termination fees as indicated in epic’s official website.
11.2. You can help protect the security of your Personal Information as well. For instance, never give out your password, since this is what is used to access your Account, or Registration Information. Also, remember to log out of your account so that other people using the same device won’t have access to your information.
Non Commercially Available
Offer: Discounted Monthly Fee for the provision of TV service by Epic
Terms and Conditions of the Offer:
1. Τhis Offer is valid from August 9th, 2019 until September 12th, 2021 and applies only to new Subscribers of the TV Service of Epic who sign a contract (the “Subscription Contract”) of a duration of 24 months (the “Minimum Period”).
2. According to the present Offer, the first six (6) months of subscription to the packages Standard Plus TV or Complete Plus TV of Epic’s TV Service, are discounted on the monthly fee as this is stated on the Subscription Contract.
3. At the end of the first 6 months and up to the expiry of the Minimum Period, the regular monthly fee of the selected package will apply as this is referred to, in the Subscription Contract. This fee will continue to apply after the expiration of the Minimum Period, unless the subscriber chooses a different package.
4. Τhis Offer is valid only for the period for which it is specifically offered and cannot be redeemed in cash or on credit or used as an exchange offer, in value or otherwise, to other services of Epic.
5. The present Terms and Conditions apply in conjunction and/or in addition to the terms of the Subscription Contract.

• This is an offer providing a discount on the monthly fee for the MTN TV Service.
• The offer is valid from November 1st, 2017 until February 28th, 2019 (the “Offer Period”) and applies only to new subscribers who sign up for a 24month contract.
• Subscribers, during the Offer Period, are free to pick and choose any of the below MTN TV offers:
o Standard pack: from €12.00 discounted monthly fee at €9.90
o Standard Plus pack: from €18.90 discounted monthly fee at €15.90
o Complete Plus pack: from €28.90 discounted monthly fee at €25.90
• After the expiration of the 24-month contract, the normal, non-discounted rates shall apply.
